These Terms are an agreement between you and Jaxus Labs LLC, the operator of Sparkle Photo Editor ("Sparkle," "we," "us"). By creating an account or using the app you agree to them. If you do not agree, do not use Sparkle. Please read section 12: it requires most disputes to be resolved by individual arbitration and waives class actions, unless you opt out.
These Terms add to, and do not replace, Apple's Licensed Application End User License Agreement, which also applies to your use of the app. Our Privacy Policy and Acceptable Use Policy are part of these Terms.
You must be at least 13 years old to use Sparkle, and at least 18 to use Retake or the AI Profile. If you are under the age of majority where you live, you may use Sparkle only with a parent or guardian's permission. You are responsible for your account and for keeping your sign-in details secure.
Sparkle uses artificial intelligence to restyle photos you choose (camera looks) and to edit facial expressions in photos (Retake). Results are generated by AI and may be inaccurate, imperfect, or different from what you expect - a result may not look exactly like you or the people in your photo, and may contain visual errors. Results are for personal, creative use. Do not use them to deceive anyone, to impersonate anyone, or as a factual record of what happened.
Sparkle Premium includes unlimited use for normal personal use. Every photo costs us real money to generate, so to keep the service available for everyone, very heavy use is subject to fair-use limits:
We may also temporarily limit generation for everyone during unusually high demand or to protect the service from abuse.
You agree not to use Sparkle to break the law or to harm anyone, and specifically not to do anything prohibited by the Acceptable Use Policy, including creating sexual, harassing, deceptive, or non-consensual content, or content involving minors. You also agree not to reverse-engineer the service, access it through automated means (bots, scripts, or scraping), create accounts in bulk, share or resell accounts, get around usage limits, or interfere with the service or its security.
You can stop using Sparkle and delete your account at any time in Profile → Delete Account. We may suspend or end your account if you break these Terms, if required by law, or to protect Sparkle or others. Deleting your account does not cancel an App Store subscription; cancel that through Apple.
The Sparkle app, its design, text, graphics, and sample images are owned by us or our licensors. These Terms do not give you any right to use them except as part of using the app.
Sparkle is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that Sparkle will be uninterrupted, error-free, or secure, that results will meet your expectations, or that stored photos will never be lost. Keep your own copies of anything important.
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to Sparkle. Our total liability for any claim arising from or related to Sparkle is limited to the greater of (a) the amount you paid for Sparkle in the 12 months before the claim arose, or (b) $50.
Some places do not allow certain disclaimers or limits on liability, so some of the above may not apply to you. Nothing in these Terms limits rights you have under law that cannot be waived.
If a claim is brought against us because of photos you submitted, your use of results, or your breaking these Terms or the law, you agree to cover our reasonable costs of defending it, to the extent the law allows.
Talk to us first. Before filing any claim, contact us at sparkle@looksmaxify.me and give us 60 days to try to resolve it informally.
Arbitration. If we cannot resolve it, you and we agree that any dispute arising from or relating to Sparkle or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court - except that either party may bring an individual claim in small-claims court, and either party may ask a court to stop infringement of intellectual property. The Federal Arbitration Act governs this section.
No class actions. You and we each agree to bring claims only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding.
Opting out. You can opt out of this section 12 within 30 days of first accepting these Terms by emailing sparkle@looksmaxify.me with your name, your account email, and a statement that you opt out of arbitration.
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be heard in the state or federal courts located in Miami-Dade County, Florida, unless the law where you live requires otherwise.
We may update these Terms. If a change is material, we will tell you in the app or by email before it takes effect. Continuing to use Sparkle after that means you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a part of these Terms is not a waiver of it. You may not transfer these Terms; we may transfer them as part of a sale or reorganization of the service.
Sparkle Photo Editor is operated by Jaxus Labs LLC, a Florida limited liability company, Miami, Florida, USA.
